Welcome to El Tiquetero (“we”, “us”, “our”). These Terms of Submission (“Terms”) govern:
- Event and content submissions by organisers (including event listings, pricing, images, and policies); and
- User‑generated content submitted by customers or visitors (including reviews, ratings, photos, and comments).
By submitting any event, listing information, or user content to our platform (the “Service”), you agree to these Terms in addition to our Terms of Use, Seller/Organiser Agreement (if applicable), and Privacy Notice.
1) Who these Terms apply to
- Organisers/Sellers: Individuals or entities who create event listings, set prices, upload assets, or sell tickets through the Service.
- Users/Attendees: Individuals who submit reviews, ratings, photos, comments, or other content.
If you are acting on behalf of a company, you confirm you are authorised to bind that company to these Terms.
2) Your account and eligibility
- You must be at least 18 and capable of entering into a binding contract.
- You are responsible for your account security and all activity under it.
- We may require Know‑Your‑Business (KYB) / Know‑Your‑Customer (KYC) checks, proof of identity, venue permits, or event insurance before or after approval.
3) What you can submit
- Organisers: Event details (title, description, date/time, venue, seating/standing info, age restrictions), pricing and fees, refund/cancellation policy, refund method and timing, event images and videos, event category and tags, accessibility and safety information, terms for entry, and any applicable licence or accreditation details.
- Users: Reviews, ratings, photos and videos taken at events you attended, Q&A posts, comments.
- You must ensure all submissions are accurate, complete, lawful, and not misleading. If something changes (e.g., line‑up, start time, venue), you must promptly update your listing and notify affected ticketholders via the Service where available.
4) Prohibited submissions
You must not submit content that:
- Is illegal, defamatory, obscene, hateful, harassing, threatening, or discriminatory.
- Infringes any third‑party rights, including copyright, trade marks, privacy, publicity, database rights, or moral rights.
- Contains personal data of others without lawful basis.
- Includes unauthorised advertising, affiliate links, malware, spam, or scraping.
- Misrepresents affiliation (e.g., pretending to be an artist, venue, or brand).
- Encourages unsafe or unlawful activity (e.g., capacity breaches, unlicensed events).
- Facilitates ticket touting, scalping, or circumvention of purchase limits.
We may remove or refuse any submission at our discretion, including to comply with law or protect users.
5) Intellectual property and licences
- You retain ownership of your submissions.
- You grant us a worldwide, non‑exclusive, transferable, sublicensable, royalty‑free licence to host, store, reproduce, modify (e.g., for formatting), communicate, display and distribute your submission on the Service and in our marketing (including emails, social media, and ads) for the purpose of operating, promoting, and improving the Service and your event.
- You confirm you have all rights, permissions, and releases required (including model/location releases for images) and that your use and our use under this licence do not infringe the rights of any third party.
- You must not upload watermarked or rights‑restricted content unless you own the rights or have written permission.
6) Event listing standards (organisers)
- Pricing and fees: Display total prices clearly, including booking fees, facility fees, restoration levies, and taxes (e.g., VAT), before checkout. Avoid drip‑pricing.
- Availability and capacity: Listings must reflect real availability. Do not oversell capacity.
- Age restrictions: State minimum age, ID requirements, and any restrictions (e.g., under‑16s with adult).
- Accessibility: Provide clear accessibility info (e.g., step‑free access, viewing platforms, caregiver tickets).
- Safety and compliance: You are responsible for licences, venue safety, insurance, safeguarding, and compliance with applicable laws and codes (including advertising standards).
- Changes: Any material change (date/time/venue/line‑up) must be promptly reflected on the listing and communicated to ticketholders.
- Prohibited events: We may decline events that are unlawful, unsafe, or contrary to our policies.
7) Reviews and community standards (users)
- Reviews should be truthful, relevant to the event experience, and respectful.
- Disclose any conflicts (e.g., if you’re affiliated with the organiser).
- We may moderate, filter, or remove reviews that breach these Terms or applicable law.
- Organisers must not post fake reviews or incentivise reviews that do not comply with consumer law or platform policies.
8) Payments, fees, and taxes (organisers)
- If you sell tickets via the Service, you authorise us and our payment processor to collect payments, deduct platform/processing fees, chargebacks, refunds, and other amounts due, and remit net proceeds to your designated account.
- You are responsible for VAT (or relevant taxes) on your ticket sales and for providing correct tax information. We may withhold payouts where legally required or in case of disputes, chargebacks, fraud, or breach.
- Chargebacks: If a chargeback occurs, we may offset the amount (and processor fees) against your balance or invoice you. Provide timely evidence on request.
9) Cancellations, postponements, and refunds (organisers)
- You must set a clear Refund & Cancellation Policy compliant with applicable consumer laws.
- Cancellation: If an event is cancelled, you must provide refunds to affected customers within the stated timeframe.
- Postponement/material change: Provide options consistent with your policy and consumer law (e.g., new date acceptance or refund).
- You authorise us to process refunds to customers on your behalf where the platform facilitates refunds or where required by law, payment scheme rules, or our risk policies.
- You remain ultimately responsible for the event and any refunds due.
10) Verification, moderation, and takedown
- We may review, edit for formatting, request evidence (e.g., venue agreement, artist confirmation), or require updates before or after publishing a listing.
- We may unpublish or restrict access to any submission that appears inaccurate, infringing, unsafe, misleading, or in breach of these Terms or law.
- We comply with valid legal notices and may act on credible infringement reports.
11) Data protection
- Organisers must process personal data of attendees lawfully, fairly, and transparently, and use it only for the purpose collected (e.g., ticket fulfilment, entry management, safety).
- Do not export or use attendee data for unrelated marketing unless you have a lawful basis and appropriate consents where required.
- You must implement appropriate security measures and honour data subject rights requests that apply to you.
- Our handling of personal data is described in our Privacy Notice.
- If we share attendee data with you as a controller or processor, additional data terms may apply.
12) Warranties and organiser responsibilities
You warrant that:
- Your submissions are accurate, lawful, and do not infringe third‑party rights.
- You have all licences, permissions, insurance, and safety measures for your events and venues.
- You will promptly correct inaccuracies and cooperate in resolving customer issues, chargebacks, or regulatory queries.
13) Our role
Unless expressly stated otherwise, we are a platform facilitating submissions, listings, and (where enabled) payments. We are not the event organiser and do not assume responsibility for the event’s delivery, safety, quality, or legal compliance.
14) Liability
- Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.
- To the fullest extent permitted by law, we are not liable for: (a) losses arising from inaccurate submissions; (b) indirect, special, or consequential losses; (c) loss of profits, revenue, or goodwill; (d) events cancelled, postponed, or altered by organisers; (e) user disputes; or (f) outages or delays.
- Our total aggregate liability for claims arising out of or relating to these Terms is limited to the greater of: (i) £100; or (ii) the platform fees paid to us by you for the submission giving rise to the claim in the 3 months preceding the claim.
15) Indemnity (organisers)
You agree to indemnify and hold harmless us, our affiliates, and personnel from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your submissions or events; (b) your breach of these Terms; (c) infringement of third‑party rights; (d) failure to provide refunds required by law; or (e) regulatory fines attributable to your actions.
16) Intellectual property complaints
If you believe content on the Service infringes your rights, please contact us at info@eltiquetero.com with:
- A description of the work or right claimed;
- The URL(s) of the allegedly infringing material;
- Your contact details;
- A statement of good‑faith belief and authority to act;
- Any supporting evidence.
We may remove or disable access to disputed content while we investigate.
17) Communications and notices
We may contact you via the email and phone associated with your account. Legal notices may be sent to info@eltiquetero.com and are deemed received when acknowledged.
18) Suspension and termination
We may suspend or terminate your submission or account if we reasonably believe you breached these Terms, pose a risk (e.g., fraud or safety), or if required by law, regulator, or payment scheme rules. You may close your account at any time, but existing obligations (e.g., refunds) survive.
19) Changes to these Terms
We may update these Terms periodically. Material changes will be notified via the Service or email. Continued submission after the effective date constitutes acceptance of the updated Terms.
20) Governing law and jurisdiction
These Terms and any non‑contractual obligations arising out of them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers residing in the UK or EU may benefit from mandatory local consumer protections.
21) General
- If a provision is invalid or unenforceable, the remainder remains in effect.
- You may not assign these Terms without our prior written consent. We may assign to an affiliate or acquirer.
- Headings are for convenience only and do not affect interpretation.
- These Terms form part of our broader contractual framework with you (e.g., Terms of Use, Privacy Notice, Seller/Organiser Agreement).
Plain‑English summary (non‑binding)
- Keep your listings accurate, legal, and transparent on price and policies.
- Don’t upload content you don’t own or that breaks the law.
- We can moderate, remove, or refuse submissions.
- Organisers are responsible for events, compliance, and refunds.
- We’re mainly a platform; our liability is limited.
- Data must be handled lawfully; extra rules apply if you receive attendee data.
- These Terms are under English law.
